TERMS AND CONDITIONS - THE IMPORTANT STUFF

Please read this page carefully. By submitting an order on this website you are agreeing to the terms that appear below which will apply to any purchase made via this web site either manually or online.

To shop with us, you must be eighteen years of age or over.

  1. Purchase Contract:
    1. This web site is operated by OrganicBox.com.au ("we", "us" or "our"). 
    2. All purchases made on this web site are governed by these Terms and Conditions. 
    3. We sell goods only to end-user consumers, unless prior arrangements have been made.
    4. All goods are sold subject to the condition that they will not be re-sold or otherwise circulated without our prior written consent.
    5. Payment for orders is currently through the PayPal interface; Direct Deposit; Accounts for approved customers and soon Credit Card payment.
    6. Once payment has been made a copy of your order will be emailed to you along with your paypal receipt. 
    7. If paying by direct deposit please use the banking receipt as proof of payment and forward a copy to vanessa@organicbox.com.au or vjcorganics@gmail.com
    8. Bank details are: Organicbox; BSB-105159; A/C-025894640; Ref-customer surname).
    9. Once payment has been made via PayPal or Direct Deposit at this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.
    10. If by some mistake a product is delivered to you in error that we know about we will contact you asking for either payment or to make arrangements to collect.  Similarly if we do pack an item in error we would appreciate your advising us of the error so appropriate arrangements can be made.  These arrangements could be payment, collection or we may offer these as a gift.
    11. Any customer paying by Direct Deposit that fails to agree by sale terms and conditions to complete the payment transaction prior to delivery is advised that Organicbox will apply a late payment and admin fee of $5.00 per week for every week the funds are not deposited after Organicbox has delivered food in good faith to said customer.  If monies are still outstanding after 3 weeks Organicbox will seek the services of our lawyer, small claims court or a debt collection agency to recover all outstanding monies owed.  All fees incurred in hiring our lawyer or a debt collection agency will be transferred to the account of the customer in each individual case.  Organicbox is not liable for any fees incurred in the cost of recovering monies due for non-payment of delivered boxes. ** Please do not place an order if you do not have the money to pay for it **
  2. Price and Delivery Charges:
    1. The price of the goods will be as quoted on the web site at the time you confirm your order (usually by clicking the "Pay Now" button).
    2. If you subsequently amend your order, the prices charged will be those applicable to the amended item(s)at the time that the amended order is confirmed. 
    3. If an order is placed and then items ordered are not available or removed from the price list the customer will be refunded the difference in the price.
    4. Weights listed in boxes are indicative only of approx quantities and to be used as a guide to what is in the boxes, we will always aim to pack over weight rather than under weight but in some instances it may be a little below for example broccoli can not be cut so it is usually a lot over weight.
    5. Depending on produce available we may in some instances increase the amount of some items to cover for a shortage in other area's eg 1kg parsnips may not be available so we may give you 1.5kg carrots.  In all cases we will strive to ensure your box is quality and value for money.
    6. Where items are ordered and sold individually by weight (such as fruit, vegetables and dry goods) the price of these items will be the price on the date you place your order.The prices stated on the website will be inclusive of any GST payable.
    7. We have a standard flat charge of $7.00 on all orders.  Current delivery area is from Greenock and the Barossa, through to Mt Barker to Seaford and McLaren Vale and everywhere in between.  Customers outside these areas are sent via Transport and individual prices apply.  We currently deliver to Peterborough, Bordertown, Mannum, Coober Pedy, Mt Compass, Encounter Bay and even Darwin.  Please email to find out about a delivery charge to your area.  If you continue to purchase from us we will ask you to add this delivery fee to all ongoing orders.
    8. Items that have been ordered but can not be supplied on the day (often due to delivery delays, weather conditions that can destroy crops, public holiday closures affecting delivery) will be substituted at the discretion of Organicbox or a Refund will be issued. 
    9. All customers are asked to advise if they do not want substitutions.
    10. Refunds will be issued in PayPal immediately following delivery - it will be on the Wednesday or Thursday.
    11. Seasonal boxes can be amended upon request if you have allergies or dislikes - just make a note in the comments box at time of purchase.
    12. Minimum order is $36.00 (including delivery fee)
    13. Share Cow program milk orders associated with the Share Cow program are only delivered if accompanied by a Fruit and Veg order, otherwise it can be collected directly from the cold room.  Please email vanessa@organicbox.com.au for details or call 1300 833 998.
    14. KCA meat orders are subject to the following terms of sale:
      1. Organicbox will take all duty of care to deliver your meat professionally packaged and frozen. 
      2. Once delivery has been made by Organicbox the buyer assumes all responsibility for the meat and agrees that Organicbox are not responsible or liable for any defrosting or deterioration of the product.   (We recommend someone is home to receive the beef).
      3. The buyer also agrees to return any ice packs provided either at the time of delivery or on return of the empty box as part of the next order.
      4. If for any reason you no longer wish to order from Organicbox we would appreciate if you can make arrangements for us to collect the foam box and ice pack, and we will refund your box deposit money. 
      5. Organicbox together with Kenton Creek Angus agree to work with all customers in relation to meat quality but firmly believe that once you try KCA beef you will be extremely happy with the quality of our Grass Fed, Hormone Free Black Angus beef.  By completing your order through to PayPal you are agreeing to the terms above.
    15. Chicken and other meat orders are subject to the following terms of sale:

  3. Methods of Payment:
    1. Payment may be made by debit, credit or charge card through Paypal interface. Or via EFTPOS Direct Deposit or over the counter cash deposit prior to delivery of boxes. 
    2. You cannot pay for your order by COD - cash or cheque.
    3. Authority for payment will be requested from your card issuer at the time of your order. We reserve the right to terminate our agreement with you if we are refused authority for payment at any stage.
    4. You agree to indemnify us in full against all costs expenses and outgoings incurred by us in obtaining payments from you in the event a failed payment occurs. This will include an administration charge.
    5. We may at any time after a failed payment has occurred ask a debt collection agency to collect payment from you or seek the services of our Lawyer to recover payment from you.
    6.   4. Delivery
    1. Delivery will be made to the address specified by you when you submit your order or have an account created.
    2. We reserve the right to restrict deliveries in certain areas, and this includes the right to eliminate certain areas from our delivery schedule altogether.
    3. Produce is subject to availability and prevailing weather conditions. The website is updated on a regular basis but in the event of non-availability of any goods you order, we may offer a reasonable substitute around the same price or weight or a refund - refunding or substitution is at the discretion of Organicbox.  Please advise when ordering if you do not want substitutions. 
    4. We will always strive to send the best of the best produce, but please take into account the nature of organics and the possibility of human error when packing.  Fruit and vegetables are fragile so Organicbox is happy to replace or refund produce where applicable, please advise immediately if you are not happy with any items in your boxes.
    5. We are currently delivering on Tuesday afternoons and Wednesdays. 
    6. At time of order please advise us of a safe, secure, cool (if possible) place for us to leave the box if you will not be home to accept delivery.   The boxes will keep your produce cold on the hottest of days - they are esky's.  In summer the boxes may also be packed on ice.
    7. Please note adverse weather conditions or other events outside of our reasonable control may result in the occasional late or cancelled delivery. If that is the case we will endeavor to contact you as soon as we are able to in order to advise the new delivery day. 
    8. We are happy to deliver to your work if it is more convenient, or if you are concerned for your box not being able to be secure or left in a cool spot.  If possible we would still like to collect your spare box but if not we will collect two on the following order.
    9. Boxes all have lids which are a tight fit, in some cases as needed they will be sealed with tape.
  5. Defective Goods
    1. We only aim to send out the best quality produce, fruit and veg are fragile, particularly organics so if for any reason you are not happy with an item in your box, email straight away so we can address the situation and offer a solution eg replacement or refund.
    2. Regarding Dairy or Dry Goods if you are at all unhappy with the quality, please contact us immediately and we will work out together the most suitable course of action.  Action could be a replacement item or a refund of the item.
  6. Orders
    1. Orders must be submitted by Monday 12 noon for inclusion in our Tuesday and Wednesday delivery run.  Please remember to advise us of the location to leave the box if you will not be home, and of any items you are allergic to.  Also please remember to leave out your empty box.
  7. Warranty and Liability
    1. Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, neither will any of these terms restrict any of your statutory rights.
    2. In addition to paragraph 4.4 we will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war.
    3. Other than as set out in clause 7.1, our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.
  8. Customer Complaints
    1. Any Customer complaints should be addressed to us via the e-mail address and telephone numbers of which are listed on our website on the "About Us" page.
  9. General
    1. If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
    2. All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us.
    3. These Terms and Conditions will be governed by South Australian law and the parties submit to the exclusive jurisdiction of the South Australian courts in relation to any dispute which may arise between them.
